General conditions of use of the digital Pass Pass services

 

ARTICLE 1: Purpose

 
The purpose of these general conditions of use is to set out the legal conditions under which the services of the digital Pass Pass servicesare provided and may be used by the “User” or “Users”.
 
The general conditions of use must be accepted by all Users wishing to access the digital Pass Pass services. These conditions constitute a contract between the digital Pass Pass services and the User. By accessing the digital Pass Pass services, Users indicate their acceptance of these general conditions of use.
As the case may be:
•         If Users refuse to accept the general conditions of use stipulated in this contract, they renounce the right to access the services offered by the digital Pass Pass services.
•        &nbspdigital Pass Pass services publisher reserves the right to modify, unilaterally and at any time, the content of these general conditions of use.

ARTICLE 3: Definitions

 
This clause defines the various essential terms used in this contract:
•         User: Any person who uses the digital Pass Pass services or any of the services that it offers.
•         User Content: Data transmitted by Users via the digital Pass Pass services.
•         Member: A User becomes a member when logged on to the digital Pass Pass services.
•         Username and password: Information required to identify a User on the digital Pass Pass services. The username and password enable Users to access services reserved for digital Pass Pass services Members. The password is confidential.

 

ARTICLE 4: Access to services

 
The digital Pass Pass services is accessible free of charge from any location in which Users have Internet access. All charges borne by Users to access the digital Pass Pass services (IT equipment, software programs, Internet connection, etc.) are the responsibility of Users.
As the case may be:
 - Users who are not Members may not access services reserved for Members. To access such services, Users must enter their username and password.
The publisher takes all necessary means to ensure good-quality access to the services available via the digital Pass Pass services. As this is an “obligation of means”, the publisher is not responsible for the result.
Digital Pass Pass services publisher may not be held liable for any force majeure events resulting in malfunction of the network or server.
Access to the digital Pass Pass services's services may be subject to interruption, suspension or modification, without prior notice, for maintenance or any other reason, at any time.
 - Users undertake to refrain from claiming compensation following the interruption, suspension or modification of this contract.

ARTICLE 5: Intellectual property

 
The trademarks, logos, signs and any other content of the digital Pass Pass services are protected by the French intellectual property code and, more specifically, copyright law.
Users must seek prior authorisation from the publisher for any reproduction, publication or copying of content.
Users undertake to use the digital Pass Pass services content strictly for private purposes only. Any use of the content for commercial purposes is strictly prohibited.
Users are solely responsible for any content that they publish online. Users undertake to refrain from publishing online any content that may adversely affect the interests of third persons. Any legal proceedings undertaken by an aggrieved third party shall be borne by Users.
User Content may be deleted or modified by the publisher at any time and for any reason. Users will not receive any explanation or notification prior to User Content being deleted or modified.

 

ARTICLE 6: Liability and force majeure

 
The sources of the information published on the digital Pass Pass services are deemed to be reliable. However, the publisher provides no guarantees as to the reliability of the said sources. The information provided on the digital Pass Pass services is strictly for guidance only. Therefore, Users assume full and sole responsibility for the use made of the information and content on the digital Pass Pass services.
Users undertake to keep their passwords confidential. Users are prohibited from disclosing their passwords, in any form whatsoever.
Users assume the risks relating to use of their usernames and passwords. The publisher assumes no liability.
Any use of the services by Users that gives rise, directly or indirectly, to a prejudice, must be subject to compensation paid to the publisher.
The publisher cannot guarantee that data will be transmitted under optimal security and confidentiality conditions. However, the publisher undertakes to implement all means necessary to provide the best possible data security and confidentiality conditions.
The publisher cannot be held liable in the event of force majeure events or unpredictable or unforeseeable events caused by third parties.

 

ARTICLE 7: Hyperlinks

 
The digital Pass Pass services contains a number of outgoing hyperlinks leading to other digital Pass Pass servicess. However, digital Pass Pass services publisher has no control over the target of these links and is in no way responsible for the webpages to which they lead. Therefore, Users may not hold the publisher liable for content and resources relating to these outgoing hyperlinks.
It is possible to create a link to a page of this digital Pass Pass services without the express authorisation of the publisher. The publisher cannot demand any prior authorisation or information with respect to a digital Pass Pass services that wishes to establish a link to the publisher's digital Pass Pass services. However, the said digital Pass Pass services should be displayed in a new browser window. The publisher reserves the right to request the deletion of a link that it considers is not in keeping with the purpose of digital Pass Pass services digital Pass Pass services.

 

ARTICLE 8: Modification of the contract

 
The publisher reserves the right to modify the provisions set out in this contract at any time.

 

ARTICLE 9: Duration

 
This contract is subject to an unlimited duration. The contract takes effect with respect to Users from the moment that they make use of the service.

 

ARTICLE 10: Applicable law and jurisdiction

 

This contract is governed by French law. In the event of a dispute that cannot be settled amicably by the Parties, the courts under the Court of Appeal of Douai have sole jurisdiction.
